La democracia en el Estado espa&ntilde;ol se basa en la supremac&iacute;a de la Ley, expresi&oacute;n de la voluntad soberana del pueblo.</dd><dd>Los derechos fundamentales de la persona son inviolables y vinculan a todos los &oacute;rganos del Estado.</dd></dl><dl><dd>Dos. La potestad de elaborar y aprobar las leyes reside en las Cortes. El Rey sanciona y promulga las leyes.</dd></dl>\r\n<p><br /> <span id=\"Art_segundo\">Art&iacute;culo segundo</span></p>\r\n<dl><dd>Uno. Las Cortes se componen del Congreso de Diputados y del Senado.</dd></dl><dl><dd>Dos. Los Diputados del Congreso ser&aacute;n elegidos por sufragio universal, directo y secreto de los espa&ntilde;oles mayores de edad.</dd></dl><dl><dd>Tres. Los Senadores ser&aacute;n elegidos en representaci&oacute;n de las Entidades territoriales. El Rey podr&aacute; designar para cada legislatura Senadores en n&uacute;mero no superior a la quinta parte del de los elegidos.</dd></dl><dl><dd>Cuatro. La duraci&oacute;n del mandato de Diputados y Senadores ser&aacute; de cuatro a&ntilde;os.</dd></dl><dl><dd>Cinco. El Congreso y el Senado establecer&aacute;n sus propios Reglamentos y elegir&aacute;n sus respectivos Presidentes.</dd></dl><dl><dd>Seis. El Presidente de las Cortes y del Consejo del Reino ser&aacute; nombrado por el Rey.</dd></dl>\r\n<p><br /> <span id=\"Art_tercero\">Art&iacute;culo tercero</span></p>\r\n<dl><dd>Uno. La iniciativa de reforma constitucional corresponder&aacute;:<dl><dd>a) Al Gobierno.</dd><dd>b) Al Congreso de Diputados.</dd></dl></dd></dl><dl><dd>Dos. Cualquier reforma constitucional requerir&aacute; la aprobaci&oacute;n por la mayor&iacute;a absoluta de los miembros del Congreso y del Senado. El Senado deliberar&aacute; sobre el texto previamente aprobado por el Congreso y si &eacute;ste no fuera aceptado en sus t&eacute;rminos, las discrepancias se someter&aacute;n a una Comisi&oacute;n Mixta, bajo la presidencia de quien ostentara la de las Cortes y de la que formar&aacute;n parte los Presidentes del Congreso y del Senado, cuatro Diputados y cuatro Senadores, elegidos por las respectivas C&aacute;maras. Si esta Comisi&oacute;n no llegara a un acuerdo o los t&eacute;rminos del mismo no merecieran la aprobaci&oacute;n de una y otra C&aacute;mara, la decisi&oacute;n se adoptar&aacute; por mayor&iacute;a absoluta de los componentes de las Cortes en reuni&oacute;n conjunta de ambas C&aacute;maras.</dd></dl><dl><dd>Tres. El Rey, antes de sancionar una Ley de Reforma Constitucional, deber&aacute; someter el Proyecto a refer&eacute;ndum de la Naci&oacute;n.</dd></dl>\r\n<p><br /> <span id=\"Art_cuarto\">Art&iacute;culo cuarto</span></p>\r\n<dl><dd>En la tramitaci&oacute;n de los Proyectos de Ley ordinaria, el Senado deliberar&aacute; sobre el texto previamente aprobado por el Congreso. En caso de que &eacute;ste no fuera aceptado en sus t&eacute;rminos, las discrepancias se someter&aacute;n a una Comisi&oacute;n Mixta, compuesta de la misma forma que se establece en el art&iacute;culo anterior.</dd></dl><dl><dd>Si esta Comisi&oacute;n no llegara a un acuerdo o los t&eacute;rminos del mismo no merecieran la aprobaci&oacute;n, por mayor&iacute;a simple, de una y otra C&aacute;mara, el Gobierno podr&aacute; pedir al Congreso de Diputados que resuelva definitivamente por mayor&iacute;a absoluta de sus miembros.</dd></dl>\r\n<p><span id=\"Art_quinto\">Art&iacute;culo quinto</span></p>\r\n<dl><dd>El Rey podr&aacute; someter directamente al pueblo una opci&oacute;n pol&iacute;tica de inter&eacute;s nacional, sea o no de car&aacute;cter constitucional, para que decida mediante refer&eacute;ndum, cuyos resultados impondr&aacute;n a todos los &oacute;rganos del Estado.</dd></dl><dl><dd>Si el objeto de la consulta se refiriera a materia de competencia de las Cortes y &eacute;stas no tomaran la decisi&oacute;n correspondiente de acuerdo con el resultado del refer&eacute;ndum, quedar&aacute;n disueltas, procedi&eacute;ndose a la convocatoria nuevas elecciones.</dd></dl>\r\n<p><strong>Disposiciones transitorias</strong><br /> Primera</p>\r\n<dl><dd>El Gobierno regular&aacute; las primeras elecciones a Cortes para constituir un Congreso de trescientos cincuenta Diputados y elegir doscientos siete Senadores a raz&oacute;n de cuatro por provincia y uno m&aacute;s por cada provincia insular, dos por Ceuta y dos por Melilla. Los Senadores ser&aacute;n elegidos por sufragio universal, directo y secreto de los espa&ntilde;oles mayores de edad que residan en el respectivo territorio.</dd></dl><dl><dd>Las elecciones al Congreso se inspirar&aacute;n en criterios de representaci&oacute;n proporcional, conforme a las siguientes bases:</dd><dd>Primera. Se aplicar&aacute;n dispositivos correctores para evitar fragmentaciones inconvenientes de la C&aacute;mara, a cuyo efecto se fijar&aacute;n porcentajes m&iacute;nimos de sufragios para acceder al Congreso.</dd><dd>Segunda. La circunscripci&oacute;n electoral ser&aacute; la provincia, fij&aacute;ndose un n&uacute;mero m&iacute;nimo inicial de Diputados para cada una de ellas.</dd></dl><dl><dd>Las elecciones al Senado se inspirar&aacute;n en criterios de escrutinio mayoritario.</dd></dl>\r\n<p>Segunda</p>\r\n<dl><dd>Una vez constituidas las nuevas Cortes:</dd></dl><dl><dd>Uno. Una Comisi&oacute;n compuesta por los Presidentes de las Cortes, del Congreso de Diputados y del Senado, por cuatro Diputados elegidos por el Congreso y por cuatro Senadores elegidos por el Senado, asumir&aacute; las funciones que el art&iacute;culo 13 de la Ley de Cortes encomienda a la Comisi&oacute;n que en &eacute;l se menciona.</dd></dl><dl><dd>Dos. Cada C&aacute;mara constituir&aacute; una Comisi&oacute;n que asuma las dem&aacute;s funciones encomendadas a la Comisi&oacute;n prevista en el art&iacute;culo 12 de la Ley de Cortes.</dd></dl><dl><dd>Tres. Cada C&aacute;mara elegir&aacute; de entre sus miembros cinco Consejeros del Reino para cubrir las vacantes producidas por el cese de los actuales Consejeros electivos.</dd></dl>\r\n<p><br /> Tercera</p>\r\n<dl><dd>Desde la constituci&oacute;n de las nuevas Cortes y hasta que cada C&aacute;mara establezca su propio Reglamento se regir&aacute;n por el de las actuales Cortes en lo que no est&eacute; en contradicci&oacute;n con la presente Ley, sin perjuicio de la facultad de acordar, de un modo inmediato, las modificaciones parciales que resulten necesarias o se estime convenientes.</dd></dl>\r\n<p><strong>Disposici&oacute;n final</strong></p>\r\n<dl><dd>La presente Ley tendr&aacute; rango de Ley Fundamental.</dd></dl><dl><dd>Dada en Madrid a cuatro de enero de mil novecientos setenta y seis.<br /><br /></dd></dl>\r\n<div style=\"text-align: right; margin-right: 0;\">JUAN CARLOS<br /><br /></div>\r\n<center>El Presidente de las Cortes Espa&ntilde;olas,<br /> TORCUATO FERN&Aacute;NDEZ-MIRANDA Y HEVIA</center></blockquote>"]]]],["element",{"elementId":"53"},["name","Enlace"],["description"],["elementTextContainer",["elementText",{"elementTextId":"18913"},["text","https://www.boe.es/buscar/doc.php?id=BOE-A-1977-165"]]]]]],["elementSetContainer",["elementSet",{"elementSetId":"1"},["name","Dublin Core"],["description","The Dublin Core metadata element set is common to all Omeka records, including items, files, and collections.
