No concretaba c&oacute;mo iba a ser el nuevo sistema pol&iacute;tico, simplemente eliminaba los obst&aacute;culos que ofrec&iacute;a el r&eacute;gimen franquista a la implantaci&oacute;n de un sistema democr&aacute;tico. Ven&iacute;a a ser, en realidad, el acta de liquidaci&oacute;n del franquismo aprobada por las propias Cortes franquistas. A lo largo del mes de noviembre la ley fue debatida por las Cortes que, bajo la presidencia de Fern&aacute;ndez Miranda, la aprobaron por 425 votos a favor con 59 votos en contra y 13 abstenciones. El gobierno quiso legitimar esta operaci&oacute;n sometiendo la nueva ley a un refer&eacute;ndum. Particip&oacute; el 77,72% del censo electoral, y el 94,17% de los participantes dieron su aprobaci&oacute;n. A partir de este momento se pod&iacute;a abrir ya el proceso electoral, segundo punto del programa de Su&aacute;rez, para elegir a los diputados de las Cortes Constituyentes encargadas de elaborar una nueva Constituci&oacute;n. Ten&iacute;a un problema importante, que era garantizar la participaci&oacute;n de la oposici&oacute;n clandestina en el proceso que ya estaba en marcha por el propio r&eacute;gimen. Para ello se enfrent&oacute; a uno de los temas m&aacute;s delicados, la legalizaci&oacute;n de la oposici&oacute;n. El 8 de febrero se aprueba un decreto ley para la Reforma Pol&iacute;tica y posteriormente, en marzo, se legalizan gran parte de los partidos pol&iacute;ticos con otro decreto ley donde se establecen los requisitos para su legalizaci&oacute;n. En caso de dudas, el Ministerio de Interior remitir&iacute;a la documentaci&oacute;n al Tribunal Supremo para que dictaminase.
