 Ley 1/1977, de 4 de enero, para la Reforma Política

Remitido a consulta de la Nación y ratificado por mayoría de votos en el referéndum celebrado el día quince de diciembre de mil novecientos setenta y seis el Proyecto de Ley para la Reforma Política, de rango Fundamental, que había sido aprobado por las Cortes en sesión plenaria del dieciocho de noviembre de mil novecientos setenta y seis,

Artículo primero

\r\n
Uno. La democracia en el Estado español se basa en la supremacía de la Ley, expresión de la voluntad soberana del pueblo.
Los derechos fundamentales de la persona son inviolables y vinculan a todos los órganos del Estado.
Dos. La potestad de elaborar y aprobar las leyes reside en las Cortes. El Rey sanciona y promulga las leyes.

Artículo segundo

\r\n
Uno. Las Cortes se componen del Congreso de Diputados y del Senado.
Dos. Los Diputados del Congreso serán elegidos por sufragio universal, directo y secreto de los españoles mayores de edad.
Tres. Los Senadores serán elegidos en representación de las Entidades territoriales. El Rey podrá designar para cada legislatura Senadores en número no superior a la quinta parte del de los elegidos.
Cuatro. La duración del mandato de Diputados y Senadores será de cuatro años.
Cinco. El Congreso y el Senado establecerán sus propios Reglamentos y elegirán sus respectivos Presidentes.
Seis. El Presidente de las Cortes y del Consejo del Reino será nombrado por el Rey.

Artículo tercero

\r\n
Uno. La iniciativa de reforma constitucional corresponderá:
a) Al Gobierno.
b) Al Congreso de Diputados.
Dos. Cualquier reforma constitucional requerirá la aprobación por la mayoría absoluta de los miembros del Congreso y del Senado. El Senado deliberará sobre el texto previamente aprobado por el Congreso y si éste no fuera aceptado en sus términos, las discrepancias se someterán a una Comisión Mixta, bajo la presidencia de quien ostentara la de las Cortes y de la que formarán parte los Presidentes del Congreso y del Senado, cuatro Diputados y cuatro Senadores, elegidos por las respectivas Cámaras. Si esta Comisión no llegara a un acuerdo o los términos del mismo no merecieran la aprobación de una y otra Cámara, la decisión se adoptará por mayoría absoluta de los componentes de las Cortes en reunión conjunta de ambas Cámaras.
Tres. El Rey, antes de sancionar una Ley de Reforma Constitucional, deberá someter el Proyecto a referéndum de la Nación.

Artículo cuarto

\r\n
En la tramitación de los Proyectos de Ley ordinaria, el Senado deliberará sobre el texto previamente aprobado por el Congreso. En caso de que éste no fuera aceptado en sus términos, las discrepancias se someterán a una Comisión Mixta, compuesta de la misma forma que se establece en el artículo anterior.
Si esta Comisión no llegara a un acuerdo o los términos del mismo no merecieran la aprobación, por mayoría simple, de una y otra Cámara, el Gobierno podrá pedir al Congreso de Diputados que resuelva definitivamente por mayoría absoluta de sus miembros.

Artículo quinto

\r\n
El Rey podrá someter directamente al pueblo una opción política de interés nacional, sea o no de carácter constitucional, para que decida mediante referéndum, cuyos resultados impondrán a todos los órganos del Estado.
Si el objeto de la consulta se refiriera a materia de competencia de las Cortes y éstas no tomaran la decisión correspondiente de acuerdo con el resultado del referéndum, quedarán disueltas, procediéndose a la convocatoria nuevas elecciones.

Disposiciones transitorias
Primera

\r\n
El Gobierno regulará las primeras elecciones a Cortes para constituir un Congreso de trescientos cincuenta Diputados y elegir doscientos siete Senadores a razón de cuatro por provincia y uno más por cada provincia insular, dos por Ceuta y dos por Melilla. Los Senadores serán elegidos por sufragio universal, directo y secreto de los españoles mayores de edad que residan en el respectivo territorio.
Las elecciones al Congreso se inspirarán en criterios de representación proporcional, conforme a las siguientes bases:
Primera. Se aplicarán dispositivos correctores para evitar fragmentaciones inconvenientes de la Cámara, a cuyo efecto se fijarán porcentajes mínimos de sufragios para acceder al Congreso.
Segunda. La circunscripción electoral será la provincia, fijándose un número mínimo inicial de Diputados para cada una de ellas.
Las elecciones al Senado se inspirarán en criterios de escrutinio mayoritario.

Segunda

\r\n
Una vez constituidas las nuevas Cortes:
Uno. Una Comisión compuesta por los Presidentes de las Cortes, del Congreso de Diputados y del Senado, por cuatro Diputados elegidos por el Congreso y por cuatro Senadores elegidos por el Senado, asumirá las funciones que el artículo 13 de la Ley de Cortes encomienda a la Comisión que en él se menciona.
Dos. Cada Cámara constituirá una Comisión que asuma las demás funciones encomendadas a la Comisión prevista en el artículo 12 de la Ley de Cortes.
Tres. Cada Cámara elegirá de entre sus miembros cinco Consejeros del Reino para cubrir las vacantes producidas por el cese de los actuales Consejeros electivos.

Tercera

\r\n
Desde la constitución de las nuevas Cortes y hasta que cada Cámara establezca su propio Reglamento se regirán por el de las actuales Cortes en lo que no esté en contradicción con la presente Ley, sin perjuicio de la facultad de acordar, de un modo inmediato, las modificaciones parciales que resulten necesarias o se estime convenientes.

Disposición final

\r\n
La presente Ley tendrá rango de Ley Fundamental.
